Welcome to the American Farmstand Association LLC (“AFA,” “we,” “our,” or “us”).
By accessing or using our website, purchasing a membership, or submitting information through our forms, you agree to the following Terms of Service. If you do not agree with these terms, please do not use this website.

1. About the American Farmstand Association

The American Farmstand Association LLC is a community-driven organization that supports and promotes local farmstands, makers, bakers, and growers through listings, visibility, events, and shared resources.

Membership does not guarantee sales, traffic, or outcomes, but provides access to promotional opportunities and participation within the Association.

2. Membership & Eligibility

Membership is open to individuals and businesses that operate:

Farmstands
Maker or food-based roadside stands
Agritourism or farm-based retail experiences
Related local food or handmade goods ventures

By joining, you confirm that:

The information you provide is accurate and truthful
You have the right to represent your stand or business
Your offerings comply with applicable local, state, and federal laws

We reserve the right to refuse, suspend, or revoke membership at our discretion if a member violates these terms or acts in a way that harms the integrity of the Association.

3. Membership Levels & Fees

The American Farmstand Association offers multiple membership tiers, including but not limited to:

Stocked Stand
Destination Stand
Founding or Special Memberships (when offered)

Membership fees:

Are billed annually unless otherwise stated
Are non-refundable once a listing or promotion work has begun
May change in the future with advance notice

Upgrades may be available during an active membership term. Downgrades typically take effect at renewal.

4. Farmstand Listings & Submitted Content

By submitting photos, descriptions, logos, or other materials, you grant the American Farmstand Association permission to:

Display your content on our website and farmstand finder
Use submitted images and descriptions for promotional purposes
Share your listing through social media, email, or marketing materials

You retain ownership of your content.
You confirm that you have the right to submit and authorize its use.

We reserve the right to edit, format, or remove content for clarity, consistency, or appropriateness.

5. Accuracy of Information

While we strive to keep listings current, members are responsible for notifying us of changes including:

Location
Operating status
Seasonal availability
Product offerings

The Association is not responsible for outdated or inaccurate member-provided information.

6. Events, Features & Promotions

Participation in events, round-ups, spotlights, or promotions:

Is not guaranteed
May vary by region, season, or availability
Is subject to editorial discretion

Event participation may require additional coordination or guidelines.

7. Payment Processing

Payments are processed through third-party providers (such as GoDaddy Payments or Stripe).
We do not store or have access to your full payment details. You agree to provide valid payment information and authorize recurring charges where applicable.

8. Cancellations & Termination

Members may choose not to renew at the end of their membership term.

We may suspend or terminate access if:

False or misleading information is submitted
Conduct harms the Association or its members
Terms are violated

Termination does not entitle a member to a refund.

9. Intellectual Property

All website content, branding, logos, graphics, and written materials created by the American Farmstand Association LLC are protected intellectual property.

You may not copy, reproduce, or redistribute AFA content without written permission.

10. Limitation of Liability

The American Farmstand Association is not liable for:

Business losses
Missed opportunities
Customer interactions
Weather, seasonal, or market conditions
Third-party actions or decisions

Participation is voluntary and at your own discretion.

11. Website Use

You agree not to:

Use the website for unlawful purposes
Submit false or misleading information
Interfere with website functionality
Attempt unauthorized access to systems

12. Changes to These Terms

We may update these Terms of Service from time to time.
Updates will be posted on this page with a revised effective date.

Founding Member Agreement

Organization: American Farmstand Association, LLC (“AFA”)

1. Purpose & Mission

The American Farmstand Association exists to strengthen, connect, and elevate local farmstands across the United States. AFA is built on the belief that farmstands are more than points of sale. They are community landmarks, stewards of local food systems, and gateways to slower, more connected living.

Founding Members are early supporters who help establish the culture, credibility, and direction of AFA during its inaugural stage.

2. Founding Member Designation

A “Member” is any member who joins the American Farmstand Association during the official founding period as determined by AFA.

Founding Members receive:

Permanent recognition as a Founding Member
A Founding Member badge for approved digital and physical use
Inclusion on the AFA Founding Member listing
Early access to programs, events, and initiatives
Priority consideration for future leadership, advisory, or pilot opportunities

Founding Member status is honorary and non-transferable.

3. Community Standards & Conduct

Founding Members agree to:

Act in good faith in support of AFA’s mission and values
Foster collaboration, respect, and goodwill within the farmstand community
Respect regional diversity, local food traditions, and differing business models
Represent AFA in a manner that reflects integrity, hospitality, and professionalism

Founding Members agree not to:

Use AFA membership, materials, or access to promote or establish a competing national or regional farmstand association, directory, or platform
Misrepresent themselves as owners, officers, or official representatives of AFA unless explicitly authorized
Engage in conduct that undermines trust within the AFA community

4. Intellectual Property & Use of Materials

All AFA branding, logos, badges, maps, directories, educational resources, event formats, written content, and systems are the sole intellectual property of American Farmstand Association, LLC.

Founding Members may:

Display AFA and Founding Member badges as provided
Reference their membership in marketing and communications
Participate in AFA-sponsored events and promotions

Founding Members may not:

Alter AFA logos, badges, or branding
Reproduce, distribute, or repurpose AFA materials for non-AFA or competing purposes
Replicate AFA systems, event formats, or educational content for competing organizations or platforms

Membership does not grant ownership rights or licenses beyond those expressly stated.

5. Data, Listings & Privacy

Member listings, maps, directories, and platform data are owned and managed by AFA
Founding Members may not scrape, export, sell, or reuse member or platform data outside of AFA-approved purposes
AFA will take reasonable steps to protect member information and platform integrity

6. Term, Termination & Good Standing

Founding Member status is permanent provided the member remains in good standing.

AFA reserves the right to suspend or revoke membership if a Founding Member:

Violates this Agreement
Engages in conduct harmful to the mission, reputation, or community of AFA
Uses AFA affiliation in a misleading or exploitative manner

Termination does not grant any rights to continued use of AFA branding or materials.

7. Independent Businesses

Founding Members acknowledge that:

AFA membership does not create a partnership, joint venture, or employment relationship
Each member operates independently and is responsible for their own business operations, compliance, and liabilities

8. Modifications

AFA may update this Agreement from time to time to reflect growth, legal requirements, or evolving programs. Founding Members will be notified of material changes.

9. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State in which American Farmstand Association, LLC is registered.

10. Acceptance

By joining the American Farmstand Association as a Founding Member, you acknowledge that you have read, understood, and agree to abide by this Founding Member Agreement.

Founder’s Note 🌾

This agreement exists not to restrict creativity, but to protect the trust, collaboration, and shared values that make the farmstand community special. Founding Members are stewards of this vision, and AFA is honored to build it alongside you.
